1. ELIGIBILITY

The Services are intended for use by adults (18 years or older) acting as parents, legal guardians, or authorized professionals (educators, therapists, specialists). Any child-related features (e.g., Development Twin, AI Assistant, Personalized Development Plans) are intended to be used by and on behalf of children only under the supervision and authorization of a parent or legal guardian. Accounts may not be created by, and purchases may not be made by, anyone under 18.

2. DESCRIPTION OF SERVICES

NeuroBridge 360 provides a neurodiversity-focused ecosystem that may include:

• Digital Platform Services: access to the Development Twin, AI Assistant, Personalized Development Plans, and care-coordination tools for parents, educators, therapists, and specialists.
• NeuroTouch: an Augmentative and Alternative Communication (AAC) application, offered as a digital product and/or subscription.
• Physical Products: educational toys, NeuroTouch tablets, NeuroPod Sensory Zone hardware, and related accessories, sold through our online store.
• Digital Products: downloadable or app-based content, licenses, and premium features.
• Subscriptions: recurring access to certain app features, content, or services, billed on a recurring basis until canceled.

We reserve the right to modify, discontinue, or add to the Services, products, or features at any time.

3. ACCOUNTS

You must provide accurate, current, and complete information when creating an account and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] of any unauthorized use.

4. ONLINE STORE, ORDERS & PRICING

Our online store operates on WooCommerce. Product listings, descriptions, images, and prices are provided in good faith but may contain errors; we reserve the right to correct pricing or listing errors and to cancel any order affected by such errors, with a full refund of the amounts paid for that order.

Placing an order constitutes an offer to purchase, which we may accept or decline (e.g., for suspected fraud, product unavailability, or pricing errors). We will confirm order acceptance via email or account notification. All prices are listed in U.S. Dollars unless otherwise stated and exclude applicable taxes and shipping fees unless indicated at checkout.

5. PAYMENT METHODS

At checkout, you may pay using the payment methods made available, which may include:

• Credit/Debit Cards and Bank Payments, processed via Stripe, PayPal, and/or Bank of America merchant services;
• PayPal account payments;
• Buy-Now-Pay-Later / Deferred Payment Options, including Klarna, Affirm, and/or PayPal Pay Later, subject to approval by and the separate terms and conditions of that third-party provider, which may include interest, fees, and a credit assessment. Your agreement for a BNPL/installment plan is between you and that provider; NeuroBridge 360 is not a party to and is not responsible for that agreement, though we may receive order/payment confirmation from the provider to fulfill your order.

You represent that any payment information you provide is accurate and that you are authorized to use the selected payment method. We are not responsible for any fees, interest, or consequences arising from your use of a third-party payment or BNPL provider.

6. SUBSCRIPTIONS AND AUTO-RENEWAL

Some Services (e.g., certain NeuroTouch features, premium platform access) are offered on a subscription basis with automatic recurring billing (e.g., monthly or annually) until you cancel.

• By subscribing, you authorize us (through our payment processor) to charge your selected payment method automatically at the start of each billing period.
• You may cancel your subscription at any time through your account settings or by contacting [email protected]; cancellation will take effect at the end of the then-current billing period unless otherwise stated, and no partial refunds will be issued for the remainder of that period except as required by law or as otherwise stated in a specific product’s terms.
• We will provide reasonable advance notice of any price changes to an active subscription, and continued use after such changes constitutes acceptance.

7. PHYSICAL PRODUCTS: SHIPPING, TITLE & RISK

For physical products (educational toys, NeuroTouch tablets, NeuroPod hardware, accessories):

• Estimated shipping times are provided at checkout or via order confirmation and are not guaranteed.
• Title and risk of loss for physical products pass to you upon delivery to the shipping carrier, except where applicable consumer protection law provides otherwise.
• You are responsible for providing accurate shipping information; we are not liable for delays or non-delivery caused by incorrect address information.
• Import duties, taxes, or customs fees for international shipments (if applicable) are the responsibility of the customer unless otherwise stated.

8. DIGITAL PRODUCTS AND LICENSES

Digital products (including app access, downloadable content, and premium features) are licensed, not sold, to you for personal, non-commercial use, unless expressly stated otherwise. You may not copy, resell, sublicense, reverse-engineer, or redistribute digital products except as expressly permitted. Digital products and completed digital services are generally non-refundable once access has been granted or content has been downloaded/delivered, except as required by applicable law or as otherwise stated in our Returns & Refunds terms below.

9. RETURNS, REFUNDS & CANCELLATIONS

Unless a specific product page states otherwise:

• Physical products may be eligible for return within [Insert Number] days of delivery, provided the item is unused, in original packaging, and accompanied by proof of purchase. Return shipping costs may be the responsibility of the customer unless the return is due to a defect or our error.
• Digital products and completed services are non-refundable once delivered/accessed, except where required by law or expressly stated otherwise.
• Subscriptions may be canceled as described in Section 6; refunds for partial billing periods are not provided except as required by law.
• Refunds, where approved, will be issued to the original payment method (card, PayPal, or the applicable BNPL provider) and may take additional time to process through that provider.

“NeuroBridge 360,” “NeuroPod Sensory Zone,” “NeuroFocus,” related logos, and the NeuroTouch application (including its design, software, content, and underlying technology) are the property of NeuroBridge Group LLC and/or its licensors and are protected by trademark, copyright, patent (including pending applications), and other intellectual property laws. Except as expressly authorized, you may not use, reproduce, modify, or distribute our trademarks, content, or software without prior written consent.

11. HEALTH, DEVELOPMENTAL & PROFESSIONAL DISCLAIMER

The Services, including the Development Twin, AI Assistant, Personalized Development Plans, and NeuroTouch, are informational and supportive tools and are not a substitute for professional medical, psychological, therapeutic, or educational diagnosis, advice, or treatment. NeuroBridge 360 is not a healthcare provider, and use of the Services does not create a provider-patient relationship. Always consult a qualified professional regarding your child’s specific developmental, medical, or therapeutic needs. Any professionals connected through the platform (educators, therapists, specialists) act independently, and NeuroBridge 360 does not guarantee the accuracy, completeness, or outcome of any professional’s advice or interaction facilitated through the Services.

12. USER CONDUCT

You agree not to: use the Services for any unlawful purpose; upload harmful code or attempt to disrupt the Services; misrepresent your identity or authority to act on behalf of a child; infringe the intellectual property or privacy rights of others; or attempt to circumvent payment obligations, security measures, or access controls.

13. THIRD-PARTY SERVICES

Our Services integrate or link to third-party services, including WooCommerce (e-commerce platform), Stripe, PayPal, Bank of America merchant services, Klarna, Affirm, and PayPal Pay Later. Your use of those third-party services is subject to their own respective terms of service and privacy policies, which we encourage you to review. NeuroBridge 360 is not responsible for the acts, omissions, availability, or performance of these third-party providers.

14. DISCLAIMER OF WARRANTIES

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW OR ANY APPLICABLE MANUFACTURER’S WARRANTY ACCOMPANYING A PHYSICAL PRODUCT.

15. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEUROBRIDGE GROUP LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

16. INDEMNIFICATION

You agree to indemnify and hold harmless NeuroBridge Group LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, misuse of the Services, or infringement of any third-party right.

17. GOVERNING LAW & DISPUTE RESOLUTION

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Broward County or Miami-Dade County, Florida, unless otherwise required by applicable consumer protection law in your jurisdiction. 18. TERMINATION

20. MISCELLANEOUS

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision does not constitute a waiver. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and NeuroBridge Group LLC regarding the Services.
